ShadowingApp Terms of Use

These Terms of Use ("Terms") set forth the conditions for using "ShadowingApp" (the "App"). All users ("Users") of the App must agree to these Terms before using the App.

Article 1 (Application)

These Terms apply to all relationships between the User and the App's developer concerning the use of the App.

Article 2 (Service Provided)

The App provides a platform for Users to practice shadowing using audio materials they import. Key features include AI-powered pronunciation assessment, loop playback of specific sections, and tracking of learning progress.

Article 3 (User Registration)

User registration may be required to use certain features of the App. Users shall provide true, accurate, and complete information.

Article 4 (Paid Services and Subscriptions)

1. In addition to free features, the App offers a paid service via a monthly or yearly subscription ("Premium Plan").
2. Details of the Premium Plan, including pricing and payment methods, are displayed on the purchase screen within the App.
3. Subscription Details:
   • Payment will be charged to your Apple ID account at the confirmation of purchase.
   • The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
   • Your account will be charged for renewal within 24 hours prior to the end of the current period.
   • You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
4. Fees paid by the User will not be refunded for any reason, except as otherwise provided by law.

Article 5 (User Content)

1. Users can generate audio data they record and its text-transcribed version (collectively, "User Content") while using the App.
2. The copyright for User Content belongs to the User. However, the App may use User Content to the extent necessary to provide the pronunciation assessment feature.
3. As stated in the Privacy Policy, User audio data is used only for pronunciation assessment and is deleted within 24 hours.
4. Users shall only use content in the App that does not infringe upon the copyrights, privacy rights, or other rights of third parties. Users are responsible for verifying the rights of any audio materials they import.

Article 6 (Prohibited Acts)

Users shall not engage in the following acts when using the App:

• Acts that violate laws or public order and morals.
• Acts related to criminal activity.
• Acts that destroy or interfere with the functions of the App's servers or network.
• Acts that may interfere with the operation of the App's services.
• Acts of collecting or storing personal information about other Users.
• Acts of impersonating other Users.
• Acts of reverse engineering, decompiling, or disassembling the App.
• Any other acts deemed inappropriate by the App.

Article 7 (Suspension of Service)

The App may suspend or interrupt all or part of the service without prior notice to the User if it determines any of the following reasons exist:

• When performing maintenance or updates on the computer system for this service.
• When provision of the service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
• In any other case where the App deems the provision of the service to be difficult.

Article 8 (Disclaimer)

1. The App shall not be liable for any damages incurred by the User as a result of using the App, except in cases of willful misconduct or gross negligence by the App.
2. The App does not guarantee the accuracy, completeness, or usefulness of the AI-powered pronunciation assessment. Please understand that learning outcomes may vary among individuals.
3. The App shall not be responsible for any transactions, communications, or disputes that arise between the User and other Users or third parties.

Article 9 (Changes to Terms of Use)

The App may change these Terms at any time without notifying the User if it deems it necessary. The revised Terms shall become effective when posted within the App or on the official website.

Article 10 (Governing Law and Jurisdiction)

1. The interpretation of these Terms shall be governed by the laws of Japan.
2. In the event of a dispute regarding this service, the court having jurisdiction over the developer's location shall be the exclusive court of first instance.
